If you want to hire a foreigner or get married and bring them to Japan, but if you want to he/she will stay in Japan for a medium to long term, he/she must obtain a residence permit.

Foreigners can go to the diplomatic missions abroad in Japan to apply, but after receiving the application, they will be sent to their home country (Japan), and if they are examined and permission is given, they will be sent to the diplomatic missions abroad and issued, but it will be issued for several months. It will take a few days.

The system of conducting the examination in Japan in advance is the “Certificate of Eligibility for Status of Residence”.

 

Certificate of residence status

The Certificate of Eligibility is issued by the Minister of Justice (Immigration Bureau) in advance to determine whether the activities (employment, marriage, etc.) that foreigners landing in Japan are going to carry out in Japan are compatible with the Japanese status of residence system. It will be issued if it is judged that the conditions are met.

 

If a foreigner who has been issued a certificate of status of residence presents it to an overseas public hall in Japan and applies for a visa, the conditions for landing related to the status of residence are the conditions of the Minister of Justice (Immigration Bureau). It is treated as having completed the preliminary examination, there is no inquiry to the home country (Japan), and the visa will be issued promptly.

Similarly, landing examinations upon arrival in Japan will be conducted easily and quickly.

 

Flow / procedure

Invited guests in Japan submit an “application for Certificate of Eligibility for Status of Residence” to the Immigration Bureau

When you receive the “Certificate of Eligibility for Status of Residence”, send it to the foreigner (such as EMS at the post office).

The foreigner who received it goes to the Japanese diplomatic mission abroad with the “Certificate of Eligibility for Status of Residence” and “Passport” and applies for the issuance of a “Visa”.

After receiving a “visa”, leave for Japan

When you arrive in Japan, you will undergo a landing examination, and if you receive a “landing permit”, you will receive a residence card.

 

Important point

The examination for the issuance of the “Certificate of Eligibility for Status of Residence” will be the examination of the residence permit, so the same examination will be conducted. Therefore, it is necessary to prepare and submit equivalent documents.

In addition, the expiration date is 3 months from the date of issuance, so it is necessary to land and enter Japan by then.

 


 

外国の方を雇い入れたり、結婚したりして、日本に呼び寄せる場合ですが、日本に中長期の期間滞在する場合、在留許可を受けなければなりません。

在留資格認定証明書

在留資格認定証明書は、日本に上陸する外国人が、日本で行おうとする活動(就職・結婚など)が日本の在留資格制度に適合しているかどうかについて、法務大臣(入国管理局)が事前に審査を行い、条件に適合すると認められる場合に交付されます。

在留資格認定証明書を交付された外国人は、日本の在外公館に提示して査証(ビザ)の発給申請をした場合、在留資格に係る上陸のための条件は法務大臣(入国管理局)の事前審査を終えているものと扱われ、本国(日本)照会はなく、査証の発給が迅速に行われることになります。

同様に、日本到着時の上陸審査も簡易迅速に行われます。

 

流れ・手順

日本にいる招聘人が、入国管理局に「在留資格認定証明書交付申請」を行う

「在留資格認定証明書」の交付を受けたら、それを当該外国人に送付(郵便局のEMSなど)

受け取った外国人は、「在留資格認定証明書」と「パスポート」をもって日本の在外公館へ行き、「査証(ビザ)」の発給申請をする

「査証(ビザ)」の発給を受けたら、日本に出発

日本に到着したら、上陸審査を受け、「上陸許可」を受けたら、在留カードをもらう

 

注意点

「在留資格認定証明書」交付の審査は、在留許可の審査となりますので、同様の審査が行われます。よって、書類などは同等のものを用意、提出する必要があります。

また、有効期限は発行から3ヶ月となりますので、それまでに日本に上陸・入国する必要があります。
