という人に許可が下りる傾向があります。
よって、
日本の社会に溶け込んでいる・日本に税金をたくさん納めている・地域社会に貢献している
などを申請時に理由書にて強調する必要があります。
良い理由書を書くのは外国人の方には難しいところがありますので、
理由書作成を永住権に手慣れている行政書士に任せると、許可が下りる確率がかなり高くなります。
家族がいる場合、自分一人が申請するか？家族全員で申請するか？
家族がいる方が永住権を申請する場合、一人で申請するより家族全員で申請するのがおススメです。
なぜなら永住権は、
「日本に長く住んでいて、家族もいて、仕事も日本で、日本の社会にすっかり
溶け込んでいて、母国に帰っても居場所がないので、日本で永住したい！」
という人に永住権を許可するというものだからです。
よって、家族がいる方が家族全員で永住許可申請をしないと
「この人は日本に長くいるつもりは無いのだろうか？」
「家族はどうするのか？」
という疑念を入管に持たれてしまいます。
一人の永住許可申請より、家族全員の永住許可申請の方が書類が多くなり、
準備が大変となりますが、家族全員でそろって申請した方が許可になる可能性が大きくなります。
「日本の社会に溶け込んでいる」とう証明
・日本の地域社会とそんなに密接に関わっていない
・日本人の友達も少ない
という方もいらっしゃります。
日本にあまりなじんでいないような方が永住許可申請をする場合は、是非とも
ボランティア活動
をすることを勧めています。
何でもいいのです、日本に貢献しているという実績があれば。
・災害地に片付けのボランティア
・老人福祉関係のボランティア
・市町村で募集している各種ボランティア
その他、地域のお祭り企画に参加でも良いのです。
自分から積極的に日本社会に関わろうという姿勢があれば、それなりに入管は評価してくれます。
ただ、作り話はダメです。
実際に参加したというエビデンスが必要です。
・写真
・参加証
などなどです。
永住権を確実に取りたいなら、日本社会に溶け込んでいるという事のアピールが大切です。
永住許可申請と貯金額
永住申請をする方からよく聞かれるのが
貯金はいくらぐらいあった方が良いですかね？
というものがあります。はっきりとした基準はありません。
私が漠然と思う目安としては
年収分
くらいはあった方がいいと思います。
１年間は無収入でもやっていけるという貯金があればと思います。
日本で自活できるしっかりとした職業がある、というのが一番大切ですが、
会社に勤めていても、その会社がつぶれるということもあり得ます。
そのような場合に、年収分の貯金があれば、まずは生活ができて、
あわてずに次の仕事を見つけることができます。
また、日本に１０年もいれば多少なりとも貯金ができるでしょうし、
貯金ができないような計画性のない人間は、日本に貢献してくれそうにない
という風にも思えてくるからです。
さらに、国が一番恐れているのは、
お金が無くなって自暴自棄になって犯罪に走る
という最悪のパターンです。
永住権を目指すようなら、しっかりと貯金をしましょう！
税金！！
永住許可申請の必要書類に、
・所得税（国の税金）を納めている証明書
・地方税（市区町村）を過去５年間納めていることの証明書
があります。
永住権は、
・今までどのような事で日本に貢献していたか
・これからこの方が永住権を取得したあと、日本にどれだけ貢献してくれるか
を入管は見ます。
納税は、日本への貢献の最低限の事ですので、納税をちゃんとしているという
ところを詳しく審査されます。
よって、永住権取得を目指すなら、早いうちから納税をすることを意識して
いたほうがいいでしょう。
国の税金は、源泉徴収をしなければならないので、どのような規模の会社でも
従業員の税金を代わって納税してくれます。
しかし市区町村の税金は、規模の極小の会社は事務手続きが面倒という理由で
源泉徴収していない会社もあるので、その場合は従業員が自分で納税する必要があります。
外国人従業員の場合、日本の税制がわからない・市区町村から来る書類に
書いてある日本語が難しくて放置している、といった理由で地方税を
納税していない方もいるので、そのような方は注意が必要です。
永住権を目指すなら、まずはきちんと納税をしましょう！
法律を守る！
永住許可申請で許可が下りるのは、
日本に長年（10年間）住んでいてい、その間、日本の法律を守って暮らしている
ということが必須です。
日本の法律を守る、これがとても大切です。
法律を守らない人には当然のことながら永住してほしくないので、不許可になります。
殺人などの凶悪犯罪の人は、在留許可が取り消されて、刑期を終えたら国外退去に
なりますが、軽微な犯罪を犯す人は、罰金などで、その後の在留は続けることができます。
その軽微な犯罪の代表格が
・車のスピード超過
・駐車違反
です。
車を運転する方ならよくやってしまうでしょう。
駐車違反は、路上駐車しないようにすれば防げますが、スピード違反は、ちょっと
気が緩むとスピードが出てしまいますので、気を付ける必要があります。
入管は犯罪歴をちゃんとチェックしていますので、軽微な犯罪でも
「犯罪歴あり」
とわかってしまいます。
永住許可申請で、よく聞かれるのが
「どれくらいで犯罪歴が消えるのか」
ということですが、これはなんともわかりません。
永住許可申請こそ、入管職員の「裁量の範囲」になりますので、
その入管職員の人となりということもあります。
一番いいのが、車の運転をしない、ことです
永住権を目指す人なら、日本では車を運転しないで、バスや電車を
多用するのがおススメです。
健康保険・公的年金
以前はありませんでしたが、この頃必要になった要件が
２年間の社会保険（健康保険・公的年金）を納めていること
というものがあります。
健康保険があれば、病気になり医者にかかるときは３割負担で
済むので、外国人の皆さんは積極的に入り、さらに自分の親を
日本に連れてきて、日本の健康保険に入れようとする人もいるほどです。
しかし、公的年金の場合は、厚生年金はちゃんとした会社に勤めていれば
給料から半分・会社が半分負担して、会社が加入手続きをして掛け金を
納めてくれます。
ちゃんとしていない会社や、個人事業主に勤めていると、健康保険・
厚生年金に入ってくれない場合がありますので、そのような会社に
勤めている方は、国民健康保険・国民年金に自分で入る必要があります。
国民年金に自分で入るというのは、６５歳以上にならないと年金が出ないので
なかなかメリットを感じるところが少なく、いずれは国に帰ろうと
思っている外国人の方はなおさらでしょう。
しかし、国民年金は、途中で国に帰るという理由で脱退すると、
脱退一時金
というものがもらえて、最大半分が返ってきます。
６５歳以上になると、年額で８０万円弱を年金でもらうことができます。
国民年金の掛け金は月額１６，４１０円なので、計算してみるとかなり割のいい
年金となっています。
障害を持つと障害年金が出て、一定の要件がありますが遺族年金も出るので
国民年金は老齢年金の機能だけではありません。
